H-1B Visa Costs 2025: Everything You Need To Know About Breakdown Of Fees

The H-1B work visa program, allowing U.S. employers to hire foreign talent, comes with a set of fees that vary depending on several factors. As we approach the 2025 financial year, it's crucial for both employers and prospective applicants to be aware of these costs. Here's a breakdown of what the H-1B visa will cost in 2025.

H-1B Visa Costs in 2025

Visa

1. H-1B Registration Fee

  • Cost: $10
  • The registration fee must be paid when employers register for the annual H-1B lottery with the U.S. Citizenship and Immigration Services (USCIS). This fee has been applicable since March 2024.

2. USCIS Filing Fees

  • Base Filing Fee: $460
  • Anti-Fraud Fee: $500
  • The base filing fee of $460 applies to all H-1B petitions, while the $500 anti-fraud fee is mandatory for initial and change-of-employer petitions.

3. Additional Employer Fee for Certain Companies

  • Cost: $4,000
  • Employers with over 50 employees, where more than 50% of the workforce is on H-1B or L-1 visas, are subject to this additional fee. This fee is part of the Consolidated Appropriations Act, 2016, and will remain until September 30, 2025.

4. Premium Processing Fee (Optional)

  • Cost: $2,805
  • Employers can opt for premium processing to expedite the application process to 15 calendar days. This service, introduced in 2024, costs $2,805.

Estimated Total Costs

For Employers Not Subject to the Additional $4,000 Fee:
Total = $10 (Registration) + $460 (Base Filing Fee) + $500 (Anti-Fraud Fee) = $970

For Employers Subject to the Additional $4,000 Fee:
Total = $10 (Registration) + $460 (Base Filing Fee) + $500 (Anti-Fraud Fee) + $4,000 (Additional Employer Fee) = $4,970

With Premium Processing:
Total with Premium Processing = $3,775 (if not subject to the $4,000 fee) or $7,775 (if subject to the $4,000 fee)

Who Pays for the H-1B Visa?

The cost of the H-1B visa is typically borne by the employer, although certain fees may be passed down to the employee. Here's how the costs are generally distributed:

Employer's Responsibility:

  • Base Filing Fee ($460)
  • Anti-Fraud Fee ($500)
  • Additional Employer Fee ($4,000) for certain companies
  • Premium Processing Fee ($2,805) - optional

Employee's Responsibility:

  • H-1B Registration Fee ($10) - sometimes passed down by the employer
  • Visa Stamping Fees and Costs associated with the visa interview process at a U.S. embassy or consulate

Important Regulations to Note

  • Employer Must Pay Mandatory Fees: According to U.S. immigration laws, employers must pay the required mandatory fees, including the base filing fee, anti-fraud fee, and any additional employer fees.
  • Employee Cannot Pay Certain Fees: Employers are prohibited from passing on fees like the base filing fee and anti-fraud fee to employees, as doing so would reduce the employee's wages.

As the 2025 fiscal year approaches, it's essential for employers and employees to factor in these fees while preparing for the H-1B visa process. Proper understanding of the costs will help streamline the application process and avoid any surprises.
