Brazil Suspends Musk's X Platform Over Legal Representation Feud

A Brazilian Supreme Court justice has ordered the suspension of Elon Musk's social media platform X in Brazil. The decision came after Musk refused to appoint a legal representative in the country. This move intensifies the ongoing conflict between Musk and Justice Alexandre de Moraes over issues like free speech and misinformation.

X Platform Suspended in Brazil

Justice de Moraes had given Musk a 24-hour deadline to comply with the order, warning that X could be blocked if he failed to do so. The company has not had a representative in Brazil since earlier this month. De Moraes' decision mandates internet service providers and app stores to block access to X within five days, with the platform remaining blocked until compliance is achieved.

Legal Battle and Market Impact

Brazil is a significant market for X, which has faced challenges since Musk acquired Twitter in 2022. According to Emarketer, around 40 million Brazilians use X at least once a month. The platform has struggled with advertiser losses, making the Brazilian market crucial for its operations.

X posted on its Global Government Affairs page that it anticipated being shut down by de Moraes due to non-compliance with his orders. "When we attempted to defend ourselves in court, Judge de Moraes threatened our Brazilian legal representative with imprisonment," the company stated. "Even after she resigned, he froze all of her bank accounts."

VPN Usage and Public Reaction

Following the announcement, many Brazilian users searched for VPNs to continue accessing X by appearing to log in from outside Brazil. It remains unclear how authorities will enforce fines against those using VPNs. Mariana de Souza Alves Lima, known as MariMoon, informed her 1.4 million followers on X that she would switch to BlueSky, sharing a screenshot of her new account.

Musk has often criticised de Moraes on his platform, calling him a dictator and tyrant. "Elon Musk showed his total disrespect for Brazilian sovereignty and, in particular, for the judiciary," de Moraes wrote in his decision. He also stated that those using VPNs to access X would face daily fines of 50,000 reais ($8,900).

Historical Context and Comparisons

Brazilian judges have previously shut down Meta's WhatsApp several times due to non-compliance with police data requests. In 2022, de Moraes threatened Telegram with a nationwide shutdown for ignoring requests to block profiles and provide information. Telegram eventually complied by appointing a local representative.

X and its predecessor Twitter have been banned in several countries, including Russia, China, Iran, Myanmar, North Korea, Venezuela, and Turkmenistan. Other nations like Pakistan, Turkey, and Egypt have temporarily suspended the platform to control dissent and unrest.

Starlink's Financial Freeze

On Thursday evening, Starlink announced that de Moraes had frozen its finances in Brazil, affecting over 250,000 customers. "This order is based on an unfounded determination that Starlink should be responsible for the fines levied-unconstitutionally-against X," Starlink said in a statement. Musk responded by calling de Moraes "an outright criminal of the worst kind."

Musk later posted that SpaceX would provide free internet service in Brazil until the issue is resolved. "We cannot receive payment but don't want to cut anyone off," he wrote.

De Moraes justified freezing Starlink's assets because X didn't have enough funds to cover mounting fines. He argued that both companies are part of the same economic group.

The situation highlights ongoing tensions between tech giants and regulatory authorities worldwide. As this legal battle unfolds, it remains to be seen how it will impact both Musk's ventures and Brazilian users reliant on these services.
