Allahabad High Court Rules Against Interference in National Highway Project for Residents' Convenience

The Allahabad High Court has stated that it is not advisable for the court to intervene in the construction of national highways by the National Highways Authority of India (NHAI) solely for the benefit of certain residents. This observation came during a writ petition filed by Brikesh Kumar Mishra, who sought an underpass for village Nagwa in Ballia district on the Green Field Expressway.

In its decision, the court emphasised that national highway projects hold significant public importance. Therefore, unless there is evidence of bad faith or clear arbitrariness, the court would hesitate to interfere with such crucial public projects. The court's stance was reflected in its refusal to direct the construction of an underpass for the village.

Vital Public Importance of Highway Projects

A division bench consisting of Justice Ashwani Kumar Mishra and Justice Donadi Ramesh delivered this decision on April 8. They noted that the project's nature is crucial for public interest and that the project report considers residents' needs. However, it is impractical to connect every village directly to the expressway.

The court further highlighted that unless there is clear evidence of bad faith or arbitrariness, it would refrain from intervening in such significant public projects. This decision underscores the importance of balancing individual convenience with broader public interests in infrastructure development.

Connectivity Concerns Addressed

During the hearing, written instructions were presented to the court, indicating that proper connectivity had already been provided. Despite this, the petitioner's counsel argued that the project's provisions did not sufficiently address the village residents' needs.

The court's decision reflects a careful consideration of both public interest and individual concerns. While acknowledging residents' needs, it prioritises the broader significance of national highway projects. This approach ensures that infrastructure developments serve the greater good while addressing specific community requirements where feasible.
