Allahabad High Court Grants Relief to Owners of 81 Apartments Facing Demolition in Lucknow
The Lucknow bench of the Allahabad High Court has provided relief to flat owners facing demolition notices. Residents of 81 apartments were asked to vacate due to demolition orders issued to builders 19 years ago. The court allowed owners to apply for compounding their flats by paying a penalty, as suggested by the Lucknow Development Authority (LDA).

The court emphasised that accountability would be established for LDA officials who failed to enforce the demolition orders against builders. The bench noted that flat owners, unaware of the builders' notices, should not bear the consequences of the builders' faults. This decision was made in response to a writ petition by some Royal Green Apartment residents in Mahanagar.
Relief for Flat Owners
Justice Rajan Roy and Justice OP Shukla presided over the case, granting a stay on the apartment's demolition. The LDA's counsel, Ratnesh Chandra, had informed the bench about a previous order from a coordinate bench in a 2012 public interest litigation (PIL) that led to the demolition proceedings.
The court's decision allows flat owners to retain their homes by paying a penalty, providing them with an opportunity to regularise their properties. This move is seen as a significant relief for those who invested their savings into purchasing these flats without knowledge of any pending legal issues.
The court's order highlights the importance of holding responsible parties accountable while protecting innocent buyers. It underscores the need for transparency and proper communication between authorities and property buyers to prevent similar situations in the future.
