Delhi HC Urges Lawyers To Promote Resolution, Not Fuel Allegations In Matrimonial Cases
In a significant observation, the Delhi High Court has emphasized the critical role of lawyers in matrimonial disputes, stating that instead of intensifying conflicts, legal professionals must guide clients toward resolution and de-escalation.
People involved in matrimonial litigation frequently experience extreme emotional distress, with their personal lives coming to a near complete halt, according to a division bench made up of Justices Prathiba M. Singh and Amit Sharma.

Although the court recognized this psychological cost, it emphasized that litigants' actions must adhere to the law.Lawyers carry a great deal of responsibility, not only to their clients but also to society and the legal system. In an April 7 ruling, the bench said that their counsel should guide clients toward cooperative resolutions rather than more accusations.
The comments were made during the hearing of a plea filed by a woman who wanted criminal contempt proceedings against her estranged husband for allegedly using foul language against her attorney in a family court. Although the husband's behavior was unacceptable, the court decided against imposing jail time, stating that he might have been provoked by certain circumstances. Nonetheless, it maintained that such behavior was unacceptable, especially when it came to derogatory remarks made against opposing counsel and even a judge.
"Seeking the proper legal remedy is the proper course of action in cases of grievances. It is never acceptable to shout abuses in court, particularly when the case is being heard, the bench noted.
What should have been a court case descended into an unruly altercation between the parties' attorneys when the husband allegedly used derogatory language against the wife's attorney and the presiding judge during the July 2024 incident.
Notwithstanding the gravity of the incident, the court considered the husband's contrition, his father's illness, and the larger background of the contentious case. The bench issued a strong warning but decided against pursuing criminal contempt. The husband was ordered to compensate his estranged wife with ₹1 lakh and to verbally apologize to her lawyer in public.
The High Court further mandated that the husband fulfill his prior obligations to pay maintenance and his minor children's tuition.
The case serves as a reminder that, despite being intimate and emotional, marital conflicts need to be handled responsibly and with dignity by both parties and their attorneys.
