White House Unveils New Guidelines for Cabinet Notification

The White House has implemented new guidelines to ensure timely notification of any Cabinet heads inability to carry out their duties, prompted by Defense Secretary Lloyd Austins undisclosed hospitalization.

The White House has established a new set of guidelines to ensure that it is promptly notified whenever a Cabinet head is unable to fulfill their duties. This move comes in response to the recent incident involving Defense Secretary Lloyd Austin's secret hospitalization, which was kept from President Joe Biden and his top aides for several days.

Revised Notification Procedures

The new guidelines include a series of instructions for Cabinet agencies to follow in cases of "delegation of authority" or when secretaries temporarily transfer their authority to a deputy due to medical issues, travel, or other reasons. White House chief of staff Jeff Zients initiated a review of existing notification procedures following the disclosure of Austin's hospitalization and the Pentagon's failure to promptly alert the White House.

Standardized Protocols for Delegation of Authority

Zients emphasized the need for standardized protocols across all agencies, acknowledging that some existing guidelines differed due to varying laws, regulations, and executive orders. The new guidelines aim to ensure that all agencies have a consistent set of protocols to follow in the event of a delegation of authority.

Mandatory Notifications to the White House

Cabinet agencies are now required to notify the White House Office of Cabinet Affairs and Zients' office when they anticipate a delegation of authority and again when the delegation actually occurs. Additionally, they must provide written confirmation that the delegation is in effect and when it has ended. The interim leader assuming authority must contact their primary counterpart at the White House, and the agency must comply with any other legally required notifications, such as informing key lawmakers on Capitol Hill.

Specific Circumstances Requiring Delegation

The guidelines specify that authority should be transferred when a Cabinet official is "traveling to areas with limited or no access to communication, undergoing hospitalization or a medical procedure requiring general anesthesia, or otherwise in a circumstance when he or she may be unreachable."

Austin's Hospitalization and Delayed Notification

The Pentagon revealed earlier this month that Austin had undergone a prostatectomy to treat prostate cancer on December 22, requiring general anesthesia at Walter Reed National Military Medical Center. Austin did not inform the White House about the procedure but temporarily transferred some of his authorities to Deputy Secretary of Defense Kathleen Hicks. Austin's subsequent hospitalization and transfer of authorities to Hicks while she was on vacation in Puerto Rico further highlighted the need for improved notification procedures.

The White House's new guidelines aim to prevent future instances of delayed or inadequate notifications regarding the inability of Cabinet heads to carry out their duties. By establishing clear protocols and ensuring timely communication, the Biden administration seeks to maintain effective coordination and decision-making within the government.
