US Teacher Marc Fogel Officially Designated as Wrongfully Detained by State Department

An American teacher, Marc Fogel, has been classified as wrongfully detained by the US government, according to the State Department. Fogel, a history teacher from Pennsylvania, was arrested over four years ago in Russia on drug charges. He is currently serving a 14-year sentence after being apprehended in August 2021 at a Russian airport with what his family claims was medically prescribed marijuana.

Marc Fogel Designated Wrongfully Detained in Russia

Fogel's exclusion from a significant prisoner exchange last August, which saw the release of Wall Street Journal reporter Evan Gershkovich and corporate security executive Paul Whelan, prompted his family to urge the Biden administration to act. They pushed for his designation as wrongfully detained to facilitate his release. This designation was confirmed by officials on Friday.

US Government's Efforts and Designation

The US government has been actively working towards securing Fogel's release. "The United States has been working to secure Marc Fogel's release for some time. We have long called for his humanitarian release and tried to include him in the August 1 deal, but were unable to. The Secretary determined Marc is wrongfully detained in October," stated the department.

This designation typically transfers oversight of such cases to the Special Presidential Envoy for Hostage Affairs. This office within the State Department focuses on negotiating the release of hostages and other Americans deemed wrongfully detained abroad.

Criteria for Wrongful Detention

The State Department evaluates several factors when determining if an American imprisoned overseas is wrongfully detained. These include credible evidence of innocence or if the detention aims to influence US policy or extract concessions from the US government.
