Bangladesh Law Adviser Urges India to Extradite Sheikh Hasina Under Treaty Obligations
A senior adviser in Bangladesh's interim government has expressed strong opposition to any attempt by India to deny the extradition of former Prime Minister Sheikh Hasina. This statement follows the issuance of arrest warrants by Bangladesh's International Crimes Tribunal against Hasina and 45 others. The tribunal has ordered their appearance by November 18.

Law Adviser Asif Nazrul emphasised that India is obligated to return Hasina if the extradition treaty is interpreted correctly. He mentioned that there are numerous legal frameworks in place to ensure this. Meanwhile, the Ministry of External Affairs in New Delhi stated that Hasina arrived in India for safety reasons and remains there.
Extradition Treaty and Legal Implications
Bangladesh and India have an existing extradition treaty, which is central to the current situation. Asif Nazrul highlighted that this treaty binds India to cooperate with Bangladesh regarding Hasina's return. The interim government in Bangladesh plans to formally request her extradition once the trial process begins.
Sheikh Hasina, aged 77, arrived at Hindon airbase near Delhi on August 5 amid escalating protests in Bangladesh. These protests originated from student agitation over a controversial government job quota. Since her arrival, she has been relocated to an undisclosed location and has not made any public appearances.
Political Reactions and Diplomatic Efforts
The Dhaka Tribune reported comments from Foreign Affairs Adviser Md Touhid Hossain, who stated that the interim government would take necessary actions following the tribunal's arrest warrant. Efforts will be made to bring Hasina back to face charges alongside top Awami League leaders.
Ruhul Kabir Rizvi, a senior leader of the opposition Bangladesh Nationalist Party, criticised India's decision to provide asylum to Hasina. He described it as sheltering a criminal and insisted on using diplomatic channels for her return.
Background of Protests and Legal Challenges
Hasina faces nearly 200 charges, primarily related to murders during student protests. The unrest led to significant violence across Bangladesh, resulting in over 1,000 deaths since mid-July when the protests began. The interim government, which took charge on August 8, aims to prosecute those involved in these killings through the International Crimes Tribunal.
In a September interview, Yunus accused Hasina of making political statements from India. He urged her to remain silent until Dhaka formally requests her extradition, highlighting potential diplomatic tensions between the two countries.
The situation remains tense as both nations navigate complex legal and diplomatic challenges surrounding Sheikh Hasina's extradition. The outcome will significantly impact political dynamics within Bangladesh and its relations with India.
