DOJ Report Reveals Mount Vernon Police Department's Routine Civil Rights Violations and Misconduct

A recent report by the US Department of Justice has highlighted civil rights violations by a suburban New York police department. The Mount Vernon Police Department, located just north of New York City, has been accused of illegal arrests and unnecessary strip and cavity searches. This investigation is part of 12 inquiries into local policing practices initiated by the DOJ since 2021.

Among the cases examined, a 2020 incident involving two women aged 65 and 75 stood out. They were arrested on suspicion of drug possession, but no drugs were found in their vehicle. Despite this, they were taken to the police station and subjected to a fully nude strip search. The officers involved were later found to have lied about the women's alleged drug purchase and faced minor disciplinary actions.

Unconstitutional Practices Uncovered

The report revealed that until late 2022, it was common practice for the Mount Vernon police to strip-search every arrested individual. This practice extended to those not formally arrested, with some detained and interrogated without charges. The DOJ also noted instances where individuals were arrested for verbally criticising officers, infringing on their free speech rights.

One particularly troubling case involved the mother of a shooting victim. She was taken into custody and interrogated while her daughter, who had been hit by a stray bullet, was dying in hospital. The officers failed to provide probable cause for her detention, highlighting a pattern of unconstitutional arrests.

Financial Mismanagement and Reforms

The report also pointed out financial mismanagement within the department, which contributed to ongoing human rights violations. Low salaries hindered the recruitment and retention of quality officers and affected training and operational budgets. Despite these challenges, the city has begun implementing reforms to address these issues.

Mount Vernon Mayor Shawyn Patterson-Howard expressed commitment to working with the DOJ to rectify these problems. "We wholeheartedly support our good officers and at the same time will not tolerate and will punish unconstitutional policing," said Patterson-Howard. The city is already taking steps towards improving its policing practices.

Steps Towards Improvement

The DOJ report offered several recommendations to prevent unconstitutional strip and cavity searches in the future. It also noted that three police officers and two civilian employees were dismissed following an investigation in 2021. However, details regarding their dismissal remain unclear as the mayor's office did not respond to inquiries about these terminations.

The investigation into Mount Vernon's police force was not triggered by a single event but rather a pattern of misconduct. The findings underscore the need for systemic changes within local law enforcement agencies to protect citizens' rights effectively.
