Cohen had alleged that Trump retaliated against him by jailing him in retaliation for writing a tell-all memoir. The court ruled that the law does not provide a damages remedy for most claims that someone was jailed in retaliation for their criticisms of a president.

Lack of Legal Remedy

The three-judge panel concluded that Cohen had already obtained relief when a judge ordered his release from imprisonment to home confinement after he was abruptly put behind bars for violating restrictions on his public communications. The court stated that the law did not provide an outlet for more relief beyond that.

Cohen's Imprisonment and Release

Cohen served over a year of a three-year sentence in federal prison after pleading guilty in 2018 to tax evasion, campaign finance charges, and lying to Congress. He claimed that Trump directed him to arrange hush money payments to a porn actor to prevent damage to his 2016 presidential bid.

Cohen was initially released to home confinement due to the coronavirus outbreak in federal prisons. However, he was returned to prison weeks later when authorities claimed he failed to accept certain terms of his release. Cohen maintained that he had only sought clarification on a condition that forbade him from speaking with the media and publishing his book.

Retaliation Claims and Legal Action

After serving 16 days in solitary confinement, Cohen was eventually freed on the orders of a judge who determined that he had been jailed in retaliation for his desire to publish a book critical of the president and discuss it on social media. Consequently, Cohen filed a lawsuit against Trump, then Attorney General William P. Barr, and various prison and probation officials.

Cohen's Response and Appeal

In response to the court's decision, Cohen expressed his intention to appeal to the US Supreme Court. He emphasized the importance of protecting democracy and preventing presidents from using the Department of Justice to silence critics who exercise their First Amendment rights.

Trump's Lawyer's Statement

Alina Habba, Trump's lawyer, welcomed the court's ruling, describing Cohen's lawsuit as "doomed from its inception." She affirmed their commitment to fighting against any frivolous suits aimed at their client.
