Trouble for another AAP MLA?'Complaint against party MLA sent to Assembly'

New Delhi, Sep 3: The Delhi Police today told a city court that it has sent to the Assembly a plea seeking lodging of an FIR against AAP MLA Akhilesh Pati Tripathi for alleged forgery by obtaining medical claim from the government for his mother who was not dependent on him.

The police, in a status report filed in pursuance to the court's order, said it has sent the complaint to the Assembly to find out correct facts and inquiry was still pending there.

"As the matter relates to Delhi Vidhan Sabha office, hence the same complaint along with its enclosures has been sent to Secretary, Delhi Vidhan Sabha Office, Old Secretariat, Delhi, to find out the correct facts through vigilance department at their own level and the complaint is still pending enquiry in Vidhan Sabha," the report said.

Metropolitan Magistrate Ambika Singh also directed SHO of Civil Lines police station and the investigating officer to appear before it and file a detailed status report on the matter.

During the hearing, advocate and RTI activist Vivek Garg, who has filed the complaint, objected to the contents of the police's report saying by forwarding the complaint to the Assembly, police has disclosed the identity of the complainant before Tripathi who could tamper with the evidence.

The complainant said it was in violation of the Supreme Court guildelines. The court was hearing a complaint alleging that an offence was committed by the MLA as he had managed to reimburse his mother's medical allowance running into lakhs of rupees from Delhi government, despite the fact that his parents were not dependent on him and not entitled for the claims.

It had earlier directed officials of Civil Lines Police Station in central Delhi to file the status report by today. The complainant has said in his plea that Tripathi, in two affidavits filed before the Election Commission during the 2013 and 2015 Assembly polls, had declared that his parents were not dependent on him.

He sought that an FIR be registered against Tripathi, who is MLA from Model Town constituency here, for alleged offences of cheating, criminal breach of trust by public servant, forgery for cheating and criminal conspiracy under the IPC.
