SC Rules In Favor Of BMW India, Dismisses Defective 7 Series Case

The Supreme Court has dismissed a 15-year-old cheating case against BMW India Private Limited's managing director and other directors. The case involved the sale of a defective BMW 7 series car to GVR Infra Projects Ltd. The court ordered BMW India to pay Rs 50 lakh as compensation for the defective vehicle sold in 2009.

GVR Infra Projects initially filed a criminal complaint in 2009, alleging they were cheated by BMW India due to the sale of a faulty car. In 2012, the Andhra Pradesh High Court quashed this complaint but instructed BMW India to provide a new car to GVR Infra Projects. This directive was not contested by BMW India.

Supreme Court's Decision

On Wednesday, a three-judge bench led by Chief Justice of India DY Chandrachud decided it would not serve justice to continue with the cheating case after such a long period. They noted that BMW India had already offered to replace the defective car with a new one back in 2012, which GVR Infra Projects declined, demanding a refund instead.

The court acknowledged that while pursuing the old case wouldn't be justifiable, compensation was necessary. Considering the depreciation of the car's value over the years, they deemed Rs 50 lakh as fair compensation for GVR Infra Projects.

Background of the Case

GVR Infra Projects' complaint stemmed from their purchase of a defective BMW car in 2009. Dissatisfied with the vehicle's performance, they sought legal action against BMW India and its directors. Despite an offer from BMW India in 2012 to replace the car, GVR Infra Projects insisted on a monetary refund with interest.

The matter escalated to the Supreme Court after GVR Infra Projects challenged the Andhra Pradesh High Court's decision to quash their criminal complaint. The Supreme Court's recent ruling brings closure to this prolonged legal battle by mandating compensation instead of further litigation.
