Ex-Judges Address President Murmu Ahead of Lok Sabha Poll 2024 Results

Seven former high court judges have written to President Droupadi Murmu, urging adherence to "established democratic precedent" in case of a hung Parliament in the 2024 elections. They stressed inviting the largest pre-poll alliance to form the government to prevent horse trading.

They also appealed to Chief Justice of India D Y Chandrachud and the chief election commissioner to ensure a smooth transition of power if the ruling party loses. The letter, signed by six former Madras High Court judges and a former Patna High Court judge, voiced concerns about a potential constitutional crisis.

The letter was signed by G M Akbar Ali, Aruna Jagadeesan, D Hariparanthaman, P R Shivakumar, C T Selvam, S Vimala, and Anjana Prakash. They concurred with a May 25 statement from the Constitutional Conduct Group (CCG) of former civil servants, highlighting the President's key role in a hung parliament scenario.

They expressed confidence in the President to follow democratic norms and prevent horse trading. The judges called for the CJI and the CEC to uphold the Constitution during the transition of power.

The letter cited recent events suggesting a grim outcome, potentially ending in violence. They mentioned the Election Commission's refusal to disclose vote counts for each booth and lack of action against hate speech as major concerns.

The judges called on the Supreme Court to be proactive in preventing any crises during vote counting and result declaration. They requested the top five justices to be available during the summer vacation to address any constitutional issues.

The former judges expressed hope for a smooth election but emphasized the need for vigilance. They urged authorities and institutions to uphold the Constitution and ensure the integrity of the democratic process.

The letter concluded by emphasizing the importance of prevention over cure and reiterated the need for adherence to constitutional duties during the election period.
