Delhi Liquor Policy Case: Arvind Kejriwal Moves Supreme Court Against His Arrest

A day after the Delhi High Court rejected Aam Aadmi Party (AAP) convenor and Delhi Chief Minister Arvind Kejriwal's plea urging to quash his arrest made by the Enforcement Directorate (ED) in connection with money laundering related to Delhi Liquor Policy case, Kejriwal's representatives have approached the Supreme Court to challenge the order. On Tuesday, the Delhi High Court, in a statement, said that ED has enough evidence to make the arrest and it can not be termed as illegal. The court also noted that ED did not violate any law and arresting made was as per the process.

After the Delhi High Court's order, CM Kejriwal's counsel, advocate Rishikesh Kumar told the media that the client respects honorable court's order, but are not satisfied with it. So, they have decided to challenge the arrest in the apex court now, which comes within their rights.

"We have challenged the illegal arrest of Arvind Kejriwal. The High Court in its finding has said that the remand order is legal and secondly, they said that they had the ground to arrest. This was the findings of the High Court in today's decision. Because the order is amenable for a challenge in the Supreme Court so we are waiting for the order to come. Once the detailed order is uploaded, we will challenge it before the Supreme Court as early as possible," Rishikesh Kumar added.

During the high court's hearing, Justice Swarna Kanta Sharma said that not joining the investigation timely despite several summons has also caused delay and is impacting others who are in judicial custody.

"The court further stated that this court is of the opinion that the accused has been arrested and his arrest and remand have to be examined as per law and not as per the timing of elections. Kejriwal's challenge to the timing of arrest before General elections in the absence of any mala fide on the part of ED is not sustainable," the court said.

It was alleged that Arvind Kejriwal was actively engaged in money laundering related to now-scrapped Delhi Liqour Policy and the money was allegedly used during the Goa election campaign in 2022.
