Centre Boosts Lt Governor's Authority in Jammu & Kashmir Amid Opposition Critique
The Centre has significantly enhanced the authority of the lieutenant governor in Jammu and Kashmir. This move allows the lieutenant governor to make decisions on key matters such as police, all-India services officers, and granting prosecution sanctions. The opposition criticised this decision, calling it a step towards disempowering the people of Jammu and Kashmir.

Amendments to Transaction Rules
The Union home ministry amended the transaction rules under the Jammu and Kashmir Reorganisation Act, 2019, to provide more powers to the lieutenant governor. This Act, passed alongside the abrogation of Article 370, divided the former state into two Union territories: Jammu and Kashmir, and Ladakh. Official sources clarified that these amendments do not alter the balance of powers as outlined in the Act.
Previously, proposals related to police, public order, all-India services, and the Anti-Corruption Bureau required approval from Jammu and Kashmir's finance department before reaching the lieutenant governor. Now, such proposals must be presented directly to the lieutenant governor through the chief secretary of the Union territory. The lieutenant governor's authority also extends to appointing the advocate general and other law officers.
Opposition's Reaction
Various political parties expressed their disapproval of this move. The National Conference (NC) and Peoples Democratic Party (PDP) labelled it as a step towards disempowering Jammu and Kashmir's people. Congress condemned it as a "murder of democracy," while Apni Party called for a unified protest against the decision.
NC vice-president Omar Abdullah voiced concerns about having a powerless chief minister who would need the lieutenant governor's approval even for minor appointments. He stressed the importance of restoring full statehood for Jammu and Kashmir before elections. "The people of Jammu and Kashmir deserve better than a powerless and rubber stamp CM who will have to beg the L-G to get his/her peon appointed," he said.
Impact on Bureaucratic Matters
The lieutenant governor's role in bureaucratic matters has also been amplified. Proposals for postings and transfers of administrative secretaries, along with those concerning IAS and IPS officers, will now be routed through his office. Congress general secretary Jairam Ramesh suggested that this move indicates a dim outlook for restoring full-fledged statehood soon.
PDP chief Mehbooba Mufti's daughter and media adviser Iltija Mufti suggested that this decision aims to limit any future elected government's powers in Jammu and Kashmir. "The order seeks to disempower the powers of the next Jammu and Kashmir state government only because the BJP doesn't want to cede control or lose its iron grip over Kashmiris," she said.
Call for Unity Among Political Parties
Jammu and Kashmir Congress president Vikar Rasool Wani described this move as a "murder of democracy" that would hinder true statehood restoration. Apni Party chief Altaf Bukhari called for unity among political parties in opposing this decision. "We appeal to all parties to shun political differences and come together on this issue," he said.
Senior CPIM leader M Y Tarigami criticised these amendments as another assault on nominal rights, reducing a historic state to a bigger municipality's status. He urged all political parties to oppose this autocratic order unitedly.
Legal Framework
According to section 32 of the Act, the legislative assembly can make laws concerning any matters listed in the State List except Police and Public Order or those in the Concurrent List in the Seventh Schedule to India's Constitution. Section 53 states that the lieutenant governor shall exercise his functions at his discretion in matters outside legislative assembly powers related to all-India services, Anti-Corruption Bureau, or any other matter requiring his discretion by law.
Following these changes, decisions regarding prosecution sanctions, filing appeals, prisons, directorate of prosecution, and forensic science laboratory will also fall under the lieutenant governor's purview. The Union home ministry notification stated that no proposal requiring prior concurrence from the Finance Department regarding Police, Public Order, All India Service, or Anti-Corruption Bureau should be concurred or rejected unless placed before the lieutenant governor through the chief secretary.
This notification aims to provide better clarity on processes for smooth administration in Jammu and Kashmir. It is a simple amendment issued to avoid any ambiguity in transaction rules.
The Supreme Court has directed restoring statehood in Jammu and Kashmir at the earliest and holding assembly elections by September 30, 2024.
