Bombay High Court Refuses Bail to PFI Members Over Conspiracy Claims

The Bombay High Court, on a recent Tuesday, made a significant ruling against three individuals associated with the Popular Front of India (PFI), a group that has been banned by the Centre in 2022. Justices Ajey Gadkari and Shyam Chandak presided over the case, denying bail to Razi Ahmed Khan, Unais Umar Khaiyyam Patel, and Kayyum Abdul Shaikh. The court found prima facie evidence suggesting their involvement in activities aimed at challenging the sovereignty of India.

The accused were implicated in efforts to reconstitute India into an Islamic state by the year 2047, aligning with the objectives outlined in the PFI's Vision-2047 document. This document, according to the court's findings, served as a blueprint for their alleged anti-national activities. The bench highlighted that these individuals not only harbored such intentions but were also actively working towards recruiting others to join their cause.

According to the court's observations, there exists substantial evidence indicating that the accused, in collaboration with others, engaged in systematic actions detrimental to the nation's integrity and security. Their activities included spreading hatred against the Indian state and promoting an anti-national agenda through various propaganda channels.

The division bench pointed out that the accused shared and propagated a document titled "Vision - 2047" on social media platforms. This document was scrutinized by the court and was described as a detailed strategy aimed at transforming India into an Islamic State using all possible methods. The court underscored that such actions constituted a conspiracy against the Government of India, amounting to an attempt to wage war against it.

The prosecution argued that these individuals aimed to incite hatred towards other religions and create divisions among Indians. They reportedly held meetings to instigate members of the Muslim community against the government, citing various grievances including incidents of mob lynching. The emphasis during these gatherings was on unity within the Muslim community to oppose the country through any means necessary.

A case was registered by Maharashtra's Anti-Terrorism Squad (ATS) under several charges including criminal conspiracy and promoting enmity between different religious groups, under the Indian Penal Code and the Unlawful Activities Prevention Act. This legal action followed a covert meeting of PFI members attended by the accused in June 2022, where strategies for mobilizing against perceived injustices were discussed.

This ruling underscores the judiciary's stance on maintaining national integrity and highlights the ongoing efforts to curb activities deemed harmful to India's sovereignty and social harmony. The denial of bail for these individuals reflects the seriousness with which such cases are treated, emphasizing the commitment to safeguarding the nation against divisive forces.
