Ex-Soldier's Life Sentence Overturned by Allahabad High Court After Four Decades
Forty-one years after a former soldier received a life sentence for murder, the Allahabad High Court has overturned the verdict. The court cited inconsistencies in witness statements as the reason. Justices Siddhartha Varma and Ram Manohar Narayan Mishra presided over the case and granted Murari Lal's petition. Lal is currently out on bail.

Contradictory Witness Statements
The First Information Report (FIR) filed on July 6, 1982, alleged that Murari Lal shot Seodan Singh's brother, Pool Singh, with his licensed firearm. Pool Singh was reportedly travelling from his village to Wazeerganj at the time. A sessions court in Badaun convicted Lal under Section 302 of the Indian Penal Code (IPC) on May 3, 1983, sentencing him to life imprisonment.
The high court noted significant contradictions in witness testimonies. Prosecution witness 1 claimed the body was taken to the police station from the crime scene. However, prosecution witness 4 stated that the body was never at the police station. These discrepancies were highlighted in the court's order last month.
Evaluation of Sole Eye-Witness
The high court also questioned the reliability of prosecution witness 2, who was the sole eye-witness. The court observed that his statements were not corroborated by other witnesses present at the scene. "The evidence of the sole eye-witness had to be examined properly and with caution which has not been done in the present case," stated the court.
In its judgment dated August 14, the high court emphasised that these contradictions were glaring and could not be ignored. The bench concluded that these inconsistencies cast doubt on the prosecution's case against Lal.
The decision to overturn Lal's conviction brings an end to a legal battle spanning over four decades. The case highlights the importance of consistent and corroborated witness statements in securing convictions.
