Spurious drug case: HC asks drug controller to appear

Allahabad, Nov 26 (UNI) The Allahabad High Court today took a serious note for non compliance of its order, whereby the Drug Controller and Director General, Health Services and also Uttar Pradesh DGP were directed to take stringent measures to apprehend the absconding persons in the spurious drug related offences.

The court in its order said the state authorities instead of taking effective measures for apprehending the persons, they were passing the buck to subordinate officials. The Judges, therefore directed the Chief Secretary, UP, to consider for calling a joint meeting of the food drug and medical health department officers along with police authorities for evolving a coordinate common strategy for putting a check on the menace of spurious drug.

The court has directed to hear this case again on January 6, 2009 for further orders and on that date the court has directed for the personal presence of Drug Controller and Director General (health services).

This order was passed by a division bench consisting of Justice Amar Saran and Justice R N Mishra on a writ petition filed by Brahmaji. In compliance of the High Court's order, a common affidavit was filed on the behalf of principal secretary, medical and health, drug controller, UP and director general, health services, UP. An affidavit was also filed by the DGP, UP but the Court was not satisfied with the said affidavits.

The Court was not satisfied with the explanation/compliance in these matters by the drug controller and the director general, health services and has asked the principal secretary (medical health), UP and other apex authorities in the police department, to submit an affidavit and to be present in the Court on the subsequent date of listing to submit an explanation for the inadequate response and compliance of the Court's order.
