The commission first dismissed the complaint in March 2022, but a judge ordered a rehearing without one of its members who served as a fake elector for Trump.

Wisconsin Elections Commission Dismisses Fake Elector Complaint

Unanimous Decision

The commission released its unanimous 5-0 decision to reject the complaint on Wednesday without providing an explanation. The discussions and vote were conducted in closed meetings.

Investigation Request

The complaint sought an investigation into the actions of the fake electors and a declaration that they violated the law. In 2022, when the complaint was initially rejected, the commission attached a letter from the Wisconsin Department of Justice stating that the Republicans' attempt to cast the state's 10 electoral college votes for Trump did not constitute a breach of election laws.

Republicans' Intentions

The state Justice Department concluded that the Republicans were legitimately attempting to preserve Trump's legal standing while courts determined the winner of the election between Trump and Biden.

Fake Electors in Battleground States

Fake electors convened in Wisconsin and other battleground states that Trump lost in 2020, attempting to cast ballots for him despite his defeat. Republicans involved in Wisconsin claimed they were safeguarding Trump's legal position in case his loss was overturned in court.

Legal Proceedings

The fake electors settled a lawsuit filed by Democrats seeking over $2 million in damages. The case continues against two of Trump's attorneys. As part of the settlement, the Madison-based liberal law firm Law Forward, which filed the original complaint, agreed to withdraw the second complaint. However, the elections commission retained the authority to act on the complaint, as noted by its attorney during the announcement of its rejection.

Bob Spindell's Involvement

One of the Wisconsin fake electors was Bob Spindell, a Republican member of the elections commission. He voted to dismiss the complaint last year but recused himself this time, acknowledging the impropriety of his involvement. Calls have been made for Spindell's removal from the elections commission due to his role as a fake elector.
