Judge Bans Wayne LaPierre from NRA Leadership for a Decade, Rejects Financial Monitor
A New York judge has barred Wayne LaPierre, the former head of the National Rifle Association (NRA), from holding a paid position with the organisation for ten years. However, Judge Joel Cohen declined to appoint an independent monitor to oversee the NRA's finances. This decision came on the final day of arguments in the second stage of the civil trial brought by New York Attorney General Letitia James.

Judge Cohen ruled from the bench, stating that appointing a monitor was not the appropriate remedy. He suggested that such oversight would be "time-consuming, disruptive and will impose significant costs on the NRA without corresponding benefits." Cohen also expressed concerns about "speech-chilling government intrusion on the affairs of the organisation."
LaPierre's Reaction to Monitor Appointment
Earlier in court, LaPierre argued that appointing a monitor would be "equivalent to putting a knife straight through the heart of the organisation and twisting it." He described this as an existential threat, suggesting it would signal to potential members and donors that the NRA was "being surveilled by this attorney general in New York." He added, "General James will have achieved her objective to fulfil that campaign promise of, in effect, dissolving the NRA for a lack of money and a lack of members."
The first phase of the trial earlier this year saw a jury find LaPierre and another deputy liable for misspending millions on personal expenses. Attorney General James sought an independent monitor to oversee the group's finances and compliance with whistle-blower policies. She also aimed to bar LaPierre from returning to any role within the NRA.
Internal Controls and Leadership Changes
NRA attorney Sarah Rogers stated in her closing arguments that the group had no plans to rehire LaPierre. She described him as a "visionary leader who commanded a lot of respect and deference." Rogers also mentioned that strong internal controls had been implemented, making a monitor unnecessary.
LaPierre served as CEO and executive vice president for over three decades before resigning in January ahead of the trial's first phase. During those proceedings, state lawyers accused him of using millions from the organisation for personal luxuries, including private jet trips and other gifts.
Financial Repercussions
The jury ordered LaPierre to repay nearly USD 4.4 million to the NRA. Additionally, Wilson "Woody" Phillips, the retired finance chief, was ordered to return USD 2 million. The second phase of the trial was a bench trial, meaning there was no jury, and Judge Cohen delivered the verdict.
Jeffrey Tenenbaum, an expert in nonprofit law testifying for the state, noted earlier this month that while some strides toward transparency had been made by the NRA, backsliding could occur without an independent monitor. He described their policy manual as "a dumpster fire."
Impact on Membership
An expert witness called by the NRA highlighted that since 2018, the organisation has lost over 1.3 million members. Despite claims of leadership change, several loyalists to LaPierre remain in high positions within the NRA.
Attorney General James sued the NRA and its executives in 2020 under her authority to investigate not-for-profits registered in New York. Initially seeking to dissolve the entire organisation, a judge ruled in 2022 that such allegations did not justify what he termed a "corporate death penalty."
The long-term impact of LaPierre's decade-long ban from holding any paid position within the NRA remains uncertain. However, it marks a significant chapter in ongoing legal battles concerning leadership and financial practices within one of America's most influential gun rights groups.
