Supreme Court Halts Lower Court Order on Biden's Controversial Social Media Strategy

However, last week saw a panel of three judges from the New Orleans-based 5th US Circuit Court of Appeals significantly pare down this order.

This panel removed some defendants from the case while also eliminating language within the original ruling that prohibited mere encouragement of content alterations. Despite these modifications, they concluded that there was likely unconstitutional pressure exerted by the administration upon these platforms.

Supreme Court Intervention

In response to this situation, the Biden administration appealed this decision and requested a hold be placed on it while they prepared their appeal against it. Consequently, Thursday’s Supreme Court order postponed its implementation until September 22nd giving plaintiffs until Wednesday to file their responses regarding this matter.
