Two Indian Companies Charged with Criminal Conspiracy to Import Fentanyl Precursors to the United States

Two Indian firms, Raxuter Chemicals and Athos Chemicals, face charges in the US for allegedly conspiring to distribute and import fentanyl precursor chemicals. Bhavesh Lathiya, a founder and senior executive at Raxuter Chemicals, was arrested in New York on January 4. He is detained pending trial by US Magistrate Judge Joseph A Marutollo. If found guilty, Lathiya could face up to 53 years in prison.

Indian Firms Charged with Fentanyl Import Conspiracy

This marks a significant development as it's possibly the first instance of Indian companies and executives being charged with distributing fentanyl precursor chemicals to the US. Previously, most charges for such conspiracies were directed at Chinese companies. Fentanyl, a Schedule II controlled substance, poses a severe threat in the US due to its high potency. It is about 50 times stronger than heroin and 100 times more potent than morphine.

Fentanyl's Impact and Legal Actions

Attorney General Merrick Garland stated, "We allege these companies, and a company founder and senior executive who is now in custody, conspired to distribute and import fentanyl precursor chemicals from India to the United States and Mexico." The focus remains on curbing the manufacturing of illicit fentanyl to prevent its devastating effects on American communities.

The indictment against Raxuter Chemicals and Lathiya includes charges of conspiracy to distribute and import a listed chemical, knowing it would be used for fentanyl production. They also face smuggling charges and other related offenses. Athos Chemicals faces similar accusations, including conspiracy to distribute and import a listed chemical.

Efforts to Combat Fentanyl Threat

Secretary of Homeland Security Alejandro N. Mayorkas emphasized the importance of targeting foreign exporters of precursor chemicals. "We will continue to take the fight against fentanyl directly to alleged foreign precursor chemical exporters like the companies and the individual indicted today," he said. The strategy aims to stop illicit fentanyl production before it can harm Americans.

The legal proceedings highlight ongoing efforts by US authorities to address the fentanyl crisis by targeting international sources of precursor chemicals. The case against these Indian companies underscores the global nature of this issue and the need for international cooperation in combating drug trafficking.
