Trump Can Vote in Florida After Felony Conviction but Must Submit DNA Sample

Donald Trump, the President-elect, will not face jail time, fines, or community service following his conviction in New York for hush money payments. A judge concluded the case with an unconditional discharge, meaning no penalties will be imposed. However, unless the conviction for falsifying business records is overturned, Trump will have felonies on his record, affecting certain rights.

Trump Can Still Vote After Sentencing

Trump remains eligible to vote in Florida. The state bars felons from voting but restores this right after sentence completion. For those convicted elsewhere, like Trump, voting rights are only lost if they are revoked in the state of conviction. In New York, voting rights are restored upon release from incarceration.

Impact on Gun Ownership and DNA Collection

Federal law prohibits individuals with felony convictions from owning firearms. Consequently, Trump cannot legally possess a gun. Additionally, New York mandates that all felony convicts provide a DNA sample for the state's crime databank. This involves a cheek swab to collect genetic material for analysis and entry into the database.

The DNA profiles are compared against those collected at crime scenes to identify suspects in unsolved cases. New York's databank is linked to the FBI's Combined DNA Index System and contains over 720,000 offender profiles.

Political and Business Implications

Despite his conviction, federal law does not prevent Trump from becoming president. State laws differ regarding eligibility for state and local offices for those with criminal records. Some states require a pardon or expungement to run for office, but no such restrictions exist for federal positions.

Trump's conviction might affect his business ventures. It could prevent him from holding liquor licenses personally; however, his properties are owned through corporate entities that hold these licenses. His past involvement in casinos might also be impacted since gaming licenses are typically denied to those with criminal records.

Travel and Pardon Possibilities

As President-elect, Trump can travel internationally using a diplomatic passport for official duties and retain a regular passport for personal travel. While some countries may restrict entry to individuals with felony convictions, this does not apply to Trump's current situation.

A pardon for Trump's conviction can only be granted by New York's governor since it involves state law violations. Presidential pardons do not apply here. Governor Kathy Hochul has not indicated any intention to pardon Trump and emphasised that the process requires elements like "remorse." Trump maintains his innocence and calls the case a "hoax" by Democrats.

The conviction may limit some opportunities but does not affect Trump's ability to hold federal office or travel abroad officially. His voting rights remain intact in Florida unless further legal changes occur.
