Trump Requests Dismissal of Georgia Election Case Based on Presidential Immunity Claims

Donald Trump, the President-elect, is seeking to have the Georgia election interference case against him dismissed. He argues that state courts will lack jurisdiction over him once he assumes office next month. The case is largely paused due to a pretrial appeal concerning prosecutor Fani Willis's involvement, which Trump's lawyers claim presents a conflict of interest.

Trump Seeks Dismissal of Georgia Election Case

Trump's legal team has filed a notice with the Georgia Court of Appeals. They argue that a sitting president is "completely immune from indictment or any criminal process, state or federal." They request the court to determine its jurisdiction before Trump becomes president next month. The filing contends that both the appeals and trial courts lack jurisdiction, deeming the indictment and prosecution unconstitutional.

Legal Challenges and Appeals

Trump's lawyers have asked the appeals court to dismiss his appeal for lack of jurisdiction. They also want the trial court to immediately dismiss the indictment against him. Meanwhile, former Trump campaign lawyer Kenneth Chesebro, who pleaded guilty to conspiracy in this case, has requested the trial court judge to invalidate his plea.

Chesebro was among four individuals who pleaded guilty following the indictment. His lawyer argues that invalidating his plea is necessary as it violates Chesebro's constitutional right to due process. Chesebro had been charged alongside Trump and others in August 2023 for allegedly trying to overturn Trump's 2020 election loss in Georgia.

Prosecutorial Conflict of Interest

The Georgia case initially involved 19 defendants with numerous charges, making it the most extensive of four criminal cases against Trump. U.S. Department of Justice special counsel Jack Smith recently withdrew two federal cases against Trump, citing a policy that protects a sitting president from indictment.

In Georgia, Trump and other defendants have sought to remove Willis from prosecution or dismiss the indictment due to her past relationship with Nathan Wade, a special prosecutor she appointed. Although Willis and Wade admitted their relationship, they stated it began after his hiring and ended before Trump's indictment.

Judicial Rulings and Developments

Fulton County Superior Court Judge Scott McAfee ruled that Willis's actions showed poor judgment but did not find a conflict warranting her disqualification. He allowed her prosecution to continue if Wade stepped aside, which he did. The appeal of this ruling remains pending and must be resolved by March.

Chesebro pleaded guilty in October 2023 to conspiracy related to filing false documents with a federal court in Atlanta. Prosecutors claimed he was part of a scheme involving 16 Georgia Republicans falsely declaring themselves as electors for Trump. However, McAfee quashed this count as beyond state jurisdiction.

The New York case against Trump resulted in a historic conviction, marking him as the first former president found guilty of a crime. Trump has asked a Manhattan judge to dismiss his conviction in this hush money case, arguing it would cause unconstitutional disruptions to the presidency.
