Trial Halted in North Dakota Abortion Ban Case as Judge Considers Dismissal
A trial in a lawsuit challenging North Dakota's abortion ban was cancelled on Monday. The judge is now considering whether to dismiss the case. The trial was initially scheduled for August 26-30. State District Judge Bruce Romanick informed the parties that the trial would be removed from the calendar.

The cancellation notice came nearly a week after both the state and plaintiffs presented their arguments. They debated whether the two-year-old case should be dismissed or proceed to trial. Judge Romanick stated he would issue "full findings on summary judgment and/or a new notice of trial as soon as possible following this Notice." He also paused pending trial deadlines for various court filings until further notice.
North Dakota's Abortion Ban
North Dakota's law criminalises abortion, with exceptions to prevent the mother's death or a "serious health risk," and for cases of rape or incest within the first six weeks. The plaintiffs argue that the ban violates the state constitution. They claim it is unconstitutionally vague about its exceptions for doctors and that its health exception is too narrow.
The Centre for Reproductive Rights, representing the plaintiffs, said they were unaware of any details beyond the notice. The Associated Press sent a text message to North Dakota Attorney General Drew Wrigley but did not receive an immediate response.
Legal Proceedings and Arguments
The state had filed for summary judgment to dismiss the complaint, originally brought in 2022 by the Red River Women's Clinic. Special Assistant Attorney General Dan Gaustad argued last week that the plaintiffs' case is based on hypotheticals. He stated that the clinic and its medical director, now in Minnesota, lack standing and that a trial would not make a difference.
The Red River Women's Clinic initially filed the lawsuit against North Dakota's now-repealed trigger ban after the US Supreme Court overturned Roe v. Wade. Following this decision, the clinic moved from Fargo, North Dakota, to Moorhead, Minnesota.
Amended Complaint
In 2023, North Dakota's Republican-controlled Legislature revised the state's abortion laws. Soon after these changes, the clinic, along with doctors specialising in obstetrics, gynaecology, and maternal-fetal medicine, filed an amended complaint.
The plaintiffs wanted the trial to proceed, arguing that North Dakota's abortion ban is unconstitutional. They believe it fails to provide clear guidelines for doctors and has overly restrictive health exceptions.
Judge Romanick's decision on whether to dismiss the case or proceed with a trial will be crucial in determining the future of abortion laws in North Dakota. Both sides await his findings on summary judgment and any potential new trial dates.
