Nirav Modi Extradition Case: UK Judge Says ‘High Risk Of Absconding’
Nirav Modi's extradition from the UK to India has encountered another hurdle. A London High Court judge recently denied his bail request, citing a "confidential impediment" delaying his return to India. Modi faces charges of fraud and money laundering there. The judge expressed concerns that Modi might not surrender if released, highlighting a high risk of absconding.
Justice Michael Fordham, during a hearing at the Royal Courts of Justice, reiterated these concerns. He noted substantial grounds for believing that the 54-year-old fugitive would flee if granted bail. Despite the judicial process being otherwise complete, a "confidential" legal issue has stalled Modi's extradition.

Confidential Proceedings and Legal Challenges
The nature of this "legal reason," as described by Justice Fordham, is known only to Modi, his legal team, and the Home Office. It remains undisclosed to the Crown Prosecution Service (CPS), the Indian government, or the court. Nicholas Hearn, representing Indian authorities, acknowledged this impediment but stressed its confidentiality.
Speculation suggests this issue may relate to an asylum claim. Although it has been mentioned in previous hearings, it remains unconfirmed officially. Justice Fordham emphasized that this confidentiality limits what the court can assess regarding Modi's detention or potential release risks.
Repeated Bail Attempts and Health Concerns
Since his arrest in March 2019, Modi has been held at Thameside prison in London. He has unsuccessfully applied for bail at least seven times. His legal team argues that prolonged pre-trial delays justify his release due to mental and physical health concerns and reports of threats in custody.
The judge considered these arguments anew but concluded they do not outweigh the flight risk. Modi faces three criminal cases in India: a fraud case by CBI related to Punjab National Bank, an Enforcement Directorate case on laundering fraud proceeds, and another alleging witness tampering.
Extradition Approval and Ongoing Delays
In April 2021, then UK Home Secretary Priti Patel approved Modi's extradition after British courts found a prima facie case against him. However, his surrender is still delayed due to ongoing confidential proceedings.
