New Orleans Truck Attack Victims File Lawsuit Over Alleged Preventable Security Failures

A group of victims from the New Orleans New Year's Day attack has filed a lawsuit against city officials and contractors. They allege negligence in preventing a truck ramming incident that resulted in 14 deaths and numerous injuries. The 21 plaintiffs include residents from Louisiana and visitors from states like Alabama, Florida, and Texas.

Lawsuit Filed Over New Orleans Truck Attack

Antoinette Klima, the lead plaintiff, shared a son with Reggie Hunter, who died in the attack. "I've survived Hurricane Katrina. I've lost loved ones before," Klima said. "And still nothing compares to the pain of losing Reggie and having to break the news to our son."

Legal Actions and Allegations

The lawsuit was filed in Orleans Parish Civil District Court by law firms Maples & Connick and Romanucci & Blandin. It mirrors another lawsuit filed earlier this month by six victims and a father of a deceased man. Both lawsuits accuse the city and two contractors of ignoring warnings about Bourbon Street's vulnerability to vehicle attacks.

The attacker, Shamsud-Din Jabbar, drove an F-150 truck into pedestrians on Bourbon Street around 3:15 am on New Year's Day. Police shot Jabbar dead during an exchange of gunfire at the crash scene. The lawsuits highlight that city officials were warned about such scenarios as early as April 2024.

Security Failures Highlighted

The lawsuits claim that New Orleans was replacing a faulty bollard system meant to block vehicles ahead of the Super Bowl on February 9. Michael Cerasa from Romanucci & Blandin stated, "The city of New Orleans so recklessly and outrageously mismanaged the timing of the bollard replacement system projects with a singular focus on the Super Bowl preparedness that it left the obvious and significant target night of New Years and the Sugar Bowl badly exposed."

The French Quarter Management District is also named in the lawsuit for "negligently and recklessly" replacing bollards during critical events. The New Orleans Police Department is accused of failing to follow its security measures by using a police cruiser instead of a larger truck as a barrier.

Contractor Errors and Victim Impact

Mott MacDonald is accused of implementing poorly designed security barriers that failed, while Hard Rock Construction allegedly erred by replacing bollards during one of the year's busiest nights. Hard Rock Construction did not respond to requests for comment, while other defendants declined due to ongoing litigation.

Victims had to crawl to safety amidst life-threatening injuries, leading many to fear crowded spaces now. Daniel Ortega, an Alabama resident, shared his struggles: "I have been experiencing a lot of nightmares that have caused me to go endless nights without sleep and continue to prevent me from attending public places during busy hours."

Legal Precedents and Future Steps

Romanucci & Blandin previously secured settlements for high-profile cases like George Floyd's family receiving USD 27 million from Minneapolis. They also won USD 98 million for Botham Jean's family after his fatal shooting by a Dallas officer. Attorney Antonio Romanucci did not specify damages sought for this case, stating "the losses here are immeasurable."

The attorneys described piecing together responsibility as a "jigsaw puzzle," indicating more defendants might be added later. This complex legal battle aims to address accountability for the tragedy while highlighting ongoing safety concerns in public spaces.
