Judge Declares Mistrial in Abu Ghraib Detainee Lawsuit Due to Jury Deadlock
In a significant legal development, a judge declared a mistrial after a jury reported being deadlocked, unable to reach a verdict in the trial of a military contractor implicated in the abuse of detainees at Abu Ghraib Prison in Iraq. This decision came after eight days of deliberations in Alexandria, marking a pivotal moment in the long-standing allegations surrounding the infamous prison abuses that occurred two decades ago.

The civil jury, consisting of eight members, was unable to conclude on accusations against civilian interrogators provided by Reston, Virginia-based CACI to the US Army at Abu Ghraib during 2003 and 2004. The allegations suggested that these interrogators conspired with soldiers to mistreat detainees as a strategy for "softening them up" for interrogation. This trial was notably the first instance where a US jury was presented with claims from survivors of Abu Ghraib, bringing to light the harrowing experiences faced by detainees during the US occupation of Iraq.
CACI defended its position by asserting that its employees had minimal to no interaction with the three plaintiffs involved in the case. The company argued that any responsibility for the alleged mistreatment rested with the government rather than CACI itself. However, the deadlock emerged particularly over a legal principle known as the "borrowed servants" doctrine, leading to the mistrial declaration.
Baher Azmy, representing the plaintiffs and associated with the Center for Constitutional Rights, expressed determination to honor the survivors' courage by potentially seeking a retrial. The legal team emphasized that their efforts in bringing this case forward were minimal compared to what the survivors endured.
The trial, which commenced on April 15, saw arguments from the plaintiffs' lawyers that CACI should be held liable for mistreatment even without direct evidence of their interrogators inflicting abuse. They proposed that CACI's interrogators had conspired with military police to abuse detainees. Supporting this claim were reports from two retired Army generals documenting the abuse and implicating multiple CACI interrogators in these acts.
One particular focus was on Steven Stefanowicz, a CACI interrogator accused of lying about his conduct and likely instructing soldiers to mistreat detainees. Despite Stefanowicz's denial of these accusations through a recorded video deposition, trial evidence highlighted initial reservations about his suitability as an interrogator and his rapid promotion within the prison's interrogation team.
Additionally, trial evidence revealed CACI's defense of another interrogator, Dan Johnson, even after his dismissal was sought by the Army following the public emergence of Abu Ghraib abuse photos. One such photo depicted Johnson questioning a detainee in what was determined by Army investigators as an unauthorized stress position.
This mistrial marks a critical juncture in addressing allegations of human rights abuses at Abu Ghraib Prison, underscoring ongoing legal battles and efforts to hold those responsible accountable. As discussions and potential retrials loom, this case continues to highlight significant questions regarding contractor accountability and governmental responsibility in contexts of war and detention.
