Elon Musk's X Corp. Takes Legal Action against California Over Content Moderation Law

Challenging Constitutionality

In a lawsuit filed on Friday against State Attorney General Robert Bonta, X Corp. questioned both the constitutionality and legal validity of this law. The corporation argues that the law infringes upon First Amendment rights. Assembly Bill 587 is at the center of this dispute; it requires social media platforms not only to display their content moderation policies but also biannually report to the state about how they are addressing issues such as hate speech, racism, misinformation and foreign political interference.
Interference with Editorial Judgments
X Corp.'s lawsuit contends that this legislation forces companies to engage in speech contrary to their will and unacceptably meddles with editorial judgments protected under constitutional rights. It further alleges undue pressure on companies to remove or demonetize content which is otherwise protected under constitutional provisions. The suit was lodged in Eastern District Court of California.
