Biden Grants Posthumous Pardons to Marcus Garvey and Four Others Amid Civil Rights Discussions

President Joe Biden has posthumously pardoned Marcus Garvey, a Black nationalist whose influence reached Malcolm X and other civil rights leaders. Garvey was convicted of mail fraud in the 1920s, a conviction many believe was politically motivated to suppress his growing popularity. After his conviction, Garvey was deported to Jamaica, where he passed away in 1940. Biden's decision aligns with calls from congressional leaders who argued for the pardon.

Biden also granted pardons to several individuals, including Don Scott, the speaker of the Virginia House of Delegates. Scott, convicted of a drug offense in 1994, served eight years in prison before entering politics. He expressed gratitude for the pardon, acknowledging it as a testament to redemption's power. Virginia Governor Glenn Younkin praised Scott's determination to reshape his future as inspirational.

Pardons and Commutations

Among those pardoned were advocates for immigrant rights and criminal justice reform. Ravi Ragbir, an immigrant rights activist facing deportation to Trinidad and Tobago after a 2001 conviction, received a pardon. Kemba Smith Pradia, convicted of a drug offense in 1994 and later commuted by President Bill Clinton, has since become a prison reform advocate.

Biden also commuted sentences for individuals like Michelle West, serving life for her role in a drug conspiracy. Her daughter, Miquelle West, expressed relief at the commutation, noting the hope it brings after decades of advocacy. Robin Peoples, sentenced to 111 years for bank robbery in Indiana, also had their sentence commuted under current laws that would impose lesser penalties.

Presidential Record

Biden has set a record for issuing individual pardons and commutations during his presidency. Recently, he commuted sentences for nearly 2,500 people convicted of nonviolent drug offenses. Additionally, he granted a broad pardon to his son Hunter Biden for gun and tax crimes.

The president also announced commuting sentences for 37 out of 40 individuals on federal death row. Their sentences were converted to life imprisonment as Donald Trump assumes office. Trump had overseen 13 executions during his first term amid the pandemic.

A pardon absolves guilt and punishment entirely, while a commutation reduces or eliminates punishment without clearing wrongdoing. Biden's actions reflect his commitment to what he describes as the "sacred covenant" of the nation. Speaking at Royal Missionary Baptist Church in South Carolina, he emphasized unity and support when loved ones falter.

Rev Martin Luther King Jr once said of Garvey: "He was the first man, on a mass scale and level to give millions of Black people a sense of dignity and destiny." Biden's pardons are seen as part of this legacy of dignity and justice for those wrongfully convicted or excessively punished.

As Biden prepares to leave office on Monday, it remains uncertain if he will issue more pardons or commutations before President-elect Donald Trump takes over. The possibility of preemptive pardons for Trump's critics could test presidential powers in unprecedented ways.
