West Bengal's Anti-Rape Bill Aparajita Sent to President for Consideration

West Bengal Governor C V Ananda Bose has forwarded the anti-rape Bill, known as the Aparajita Bill, to President Droupadi Murmu for her consideration. This decision came after Chief Secretary Manoj Pant provided the necessary technical report earlier in the day, according to a Raj Bhavan official.

The governor had previously criticised the Mamata Banerjee administration for not sending the required technical report along with the Bill. This report is essential for granting assent to the legislation. The Raj Bhavan also expressed dissatisfaction with the assembly and secretariat for not providing the text of debates and their translations as mandated by rules.

Governor's Concerns

Bose highlighted several issues with the Bill, pointing out its "glaring defects and lapses." He advised the state government to conduct thorough research instead of making hasty decisions. The governor warned against acting in haste and regretting it later.

The governor emphasised that it is the administration's duty to address the grievances of victims' families. Referring to a recent case where a young doctor was allegedly raped and murdered at RG Kar hospital, he stressed that people demand justice within the existing legal framework.

Pending Bills

The Aparajita Bill will now join other similar Bills from Maharashtra, Andhra Pradesh, and Arunachal Pradesh that are pending with the President. The governor noted these omissions and commissions in the hurriedly passed Bill.

The West Bengal assembly had unanimously passed the Aparajita Woman and Child West Bengal Criminal Laws and Amendment Bill 2024 on September 3. This Bill seeks capital punishment for rape convicts if their actions result in death or leave the victim in a vegetative state. It also proposes life sentences without parole for other perpetrators.

Bose stated, "People cannot wait till the Bill is implemented. They want justice and justice should be given to them within the framework of the existing law." He urged the state government to act effectively so that people receive justice promptly.
