Uttar Pradesh: Allahabad HC Scraps Petition Against Merger Of 5,000 Schools

The Allahabad High Court's Lucknow bench has supported the Uttar Pradesh government's initiative to merge small primary schools with nearby larger ones. This decision came after a petition by 51 children from Sitapur was dismissed. They had challenged the state's order from June 16, which aimed to consolidate under-enrolled schools into larger institutions, arguing it violated the Right to Free and Compulsory Education.

Despite opposition, the state government argued that merging schools would improve educational outcomes by pooling resources and enhancing learning environments. They pointed out that some schools were severely underutilised, with 18 primary schools lacking any students. The plan aims to optimise resources and provide better infrastructure and teaching staff.

Legal Backing for School Mergers

Justice Pankaj Bhatia, in a single-judge bench ruling, dismissed the petitioners' claims that merging smaller schools would disrupt education for young children. The petitioners believed this move contradicted the Right to Education Act, which guarantees free education for children aged 6 to 14. However, the court sided with the government's perspective on improving educational quality.

The government's strategy involves transferring students from these smaller schools to nearby institutions. This approach is expected to address inefficiencies in running low-enrollment schools and ensure students have access to better facilities. The merged schools will no longer function independently but will be part of larger educational setups.

Community Concerns Over School Access

Local communities and political parties have expressed concerns about the merger plan. They argue it could hinder children's access to education, especially in rural areas where schools are far apart. The petitioners highlighted that merging schools could lead to long travel times for children, making education less accessible.

Despite these objections, the government insists that the policy benefits students by providing improved educational opportunities. The plan is set to be implemented in phases over the coming months following the court's ruling.
