JK Assembly Secretariat Clarifies No Endorsement of PSA Against MLA Mehraj Malik Amid Detention

The Jammu and Kashmir Legislative Assembly Secretariat has denied endorsing the Public Safety Act against MLA Mehraj Malik, clarifying its procedural obligations regarding his detention.

The Jammu and Kashmir Legislative Assembly Secretariat has refuted claims that it endorsed the use of the Public Safety Act against Doda MLA Mehraj Malik. Malik, who leads the J-K unit of the Aam Aadmi Party (AAP), was transferred to Kathua district jail on Monday evening under this preventive detention law.

Some media outlets and social media platforms, including X (formerly Twitter), have reported that the Secretariat supported applying the Public Safety Act 1978 to Malik. The Secretariat has categorically stated that these reports are incorrect and unfounded, as it plays no part in such decisions.

Clarification on Rule 260

The Secretariat clarified its responsibilities under Rule 260 of the Rules of Procedure and Conduct of Business in the Jammu and Kashmir Assembly. This rule mandates informing all MLAs about Malik's detention. The Secretariat emphasised that its role is limited to communication, not endorsement.

Rule 260 specifies that once a communication is received as per Rule 258 or Rule 259, the Speaker must read it in the House if in session. If not, it should be published in the bulletin for members' information. This ensures transparency among assembly members regarding such matters.

The Secretariat's statement aims to correct misinformation circulating in public discourse. It stresses that its involvement is procedural, focusing on keeping assembly members informed rather than influencing legal actions.

This situation highlights the importance of accurate reporting and understanding institutional roles within legislative processes. The Secretariat's clarification serves to dispel any misconceptions about its function concerning Malik's detention under the Public Safety Act.
