Jharkhand High Court Reserves Decision on Public Interest Litigation Regarding Illegal Bangladeshi Immigrants

The Jharkhand High Court has reserved its decision on a public interest litigation concerning illegal immigrants from Bangladesh residing in the state. The case was heard by a division bench comprising Acting Chief Justice Sujit Narayan Prasad and Justice Arun Kumar Rai. The petitioner, Danish Daniel, alleged that these immigrants were taking refuge in the Santhal Parganas districts of Jharkhand.

Jharkhand High Court on Illegal Immigrants Case

During the hearing, arguments were presented by the Union government, the state government, and the petitioner. Additional Solicitor General Tushar Mehta, participating virtually, mentioned a proposed high-level fact-finding committee. This committee would include the Union home secretary and the state's chief secretary as key members to discuss the issue and submit a report.

Political Implications and Allegations

Senior lawyer Kapil Sibal, representing the state government virtually, suggested that the PIL was strategically timed to influence political outcomes ahead of the assembly elections. These elections are scheduled to take place later this year in Jharkhand. The central government had previously filed an affidavit acknowledging the presence of illegal immigrants in Pakur and Sahibganj districts.

The high court had earlier criticised district officials for providing incorrect information about the absence of illegal immigrants in Santhal Parganas. On September 18, it noted that deputy commissioners had misreported data regarding immigrant presence in these areas.

Concerns Over Local Impact

In his petition, Daniel highlighted that Bangladeshi refugees were entering Jharkhand through porous borders in Santhal Parganas. He claimed these refugees were establishing madrasas and settlements, which disrupted the local tribal communities' way of life.

The court's decision is awaited as it considers these complex issues involving immigration and local socio-political dynamics. The outcome could have significant implications for both governance and community relations in the region.
