Tragedy Recap

On Ram Navami last year, the floor of the Beleshwar Mahadev Jhulelal temple, which was built on a covered stepwell, collapsed, resulting in the deaths of 36 individuals, including 21 women and several children.

Incomplete Investigation

The division bench of Justices Justice Vivek Rusia and Anil Verma observed that neither the accused have been put on trial nor the departmental inquiry has been completed. The court directed the Station House Officer of Police Station Juni Indore to complete the investigation in the FIR and the Deputy Commissioner of Police of the concerned zone to monitor the investigation and ensure its completion before the one-year mark from the date of the incident.

Magisterial Inquiry Report

A magisterial inquiry had held Indore Municipal Corporation officials responsible for negligence in performing their duties. The report highlighted their failure to protect the stepwell and the absence of any warning signs or markings. The High Court bench expressed its disappointment that the executive magistrate submitted the report to the Indore Collector on July 11, 2023, but it was not brought to the court's attention or made public in a timely manner.

Departmental Inquiry

The court noted that assistant engineers PR Aroliya and Prabhat Tiwari were suspended on March 31, 2022, a day after the incident, and a chargesheet was issued on May 10, 2023. However, the departmental inquiry into the matter remains incomplete despite the appointment of enquiry officers.

Reopening of Wells and Stepwells

In response to concerns raised by the petitioners regarding the closure of wells and stepwells following the tragedy, the High Court ordered their reopening for public use. The court also directed the local civic body to ensure regular cleaning and maintenance of these structures.

The court acknowledged the cultural significance of stepwells, noting that they are an integral part of Indian cultural life and date back to the Indus Valley Civilization between 2500-1700 B.C.
