Delhi LG can’t sit on files, stultify governance, SC observes

The government wants the SC to lay down a law on whether the LG can unilaterally administer the NCR without being bound by aid and advise of the elected government.

The Lieutenant Governor of Delhi cannot sit on files and stultify governance, Justice D Y Chandrachud of the Supreme Court observed orally. He is bound to pass the difference of opinions between him and the council of ministers to the President for an early resolution, the judge also observed.

The observations were made during the hearing on a batch of petitions filed by Delhi Chief Minister Arvind Kejriwal. The AAP government had argued against the High Court order which declared that the LG had complete control of all matters regarding the National Capital Region.

The government wants the SC to lay down a law on whether the LG can unilaterally administer the NCR without being bound by aid and advise of the elected government.
