Delhi CM Kejriwal Seeks Supreme Court's Aid Against 'Assault on Democracy'
Delhi Chief Minister Arvind Kejriwal has called his recent arrest by the Enforcement Directorate (ED) a significant challenge to democracy's principles. This development comes as the general elections approach, with Kejriwal facing charges in a money laundering case related to an excise policy scam. He has appealed to the Supreme Court for his release, labeling the case against him as illegal.

Chief Justice of India, D.Y. Chandrachud, has been approached for an early hearing of Kejriwal's plea against his arrest, which was upheld by the Delhi High Court on April 9. The court's decision came after Kejriwal failed to respond to multiple summons and did not participate in the investigation, according to the ED.
Justice Swarana Kanta Sharma of the Delhi High Court cited ED's allegations of Kejriwal's involvement in concealing proceeds from crime as a basis for rejecting his petition against arrest. Kejriwal argues that his arrest, made after the announcement of general elections, is politically motivated.
The plea to the Supreme Court stresses that this arrest not only unlawfully restricts Kejriwal's liberty but also represents an attack on democracy, free elections, and federalism—key components of India's constitutional foundation. The petition highlights concerns over the use of contradictory statements from co-accused who have turned approvers as grounds for arrest.
Kejriwal's legal team contends that the arrest could set a dangerous precedent, potentially allowing ruling parties to detain political opponents under dubious charges before elections. This, they argue, would undermine India's democratic principles.
The appeal criticizes the High Court's judgment for its reliance on statements made under coercion and questions the procedure followed by the ED in obtaining these statements. It also accuses the ED of allowing its processes to be manipulated by those with vested interests to oppress political rivals and tarnish their reputations during election periods.
This case has sparked a debate on the balance between legal proceedings and political freedoms in India, especially in the context of upcoming elections. The Supreme Court's decision on this matter will be closely watched for its implications on political and legal norms in the country.
