Criminal case against cricketer Prithvi Shaw for 'outraging modesty'

Social media influencer Sapna Gill, who was released on bail on Monday, has filed an application seeking an FIR against cricketer Prithvi Shaw for allegedly outraging her modesty.

Gill, in her application filed through advocate Kaashif Ali Khan, sought an FIR against Shaw, his flatmate Ashish Yadav and others for alleged molestation and outraging of modesty.

As per Gill's application, she and her friend Shobhit Thakur are regular patrons of the upmarket club, where the latter spotted Shaw who was partying with friends and was allegedly inebriated. ''Thakur, who is just a teenager, was unaware of the brutality of the drunken mob. Thakur was helpless and was unable to defend himself. Hence, she (Gill) intervened and entered the fray trying to stop Shaw and others from further harming and injuring Thakur,'' as per the application.

Speaking to ANI, Gill's lawyer informed,'Criminal complaint registered against Prithvi Shaw, Ashish Surendra Yadav, Brijesh & others (not known to complainant) for illegal acts of molesting and outraging the modesty of Sapna Gill u/s 34, 120b, 144, 146, 148, 149, 323, 324, 351, 354 & 509 of IPC.''

The influencer's complaint has been registered under sections 34 (criminal act with common intention), 120B (criminal conspiracy), 146 (rioting), 148 (rioting with armed weapons), 149 (unlawful assembly offence committed in prosecution), 323 (voluntarily causing hurt), 324 (voluntarily causing hurt by dangerous weapons), 351 (use of criminal force), 354 (outrage of modesty) and 509 (advantage of proximity, gesture to outrage modesty) of the Indian Penal code.

Gill's lawyer had earlier accused Shaw of being drunk and alleged that the cricketer assaulted the influencer with a wooden bat in a ''misuse of power and position'', while the police said that Gill and Thakur were in an inebriated condition at the time of the incident.

A video of the incident has gone viral on social media, which shows Shaw being manhandled. Shaw had gone to the hotel located near the domestic airport at Santacruz for dinner with his businessman friend when the sequence of events unfolded, an official said.

As per the complaint, Thakur and Gill approached Shaw for a selfie at the hotel. Initially, the cricketer allowed them to do so. But they insisted on clicking more selfies with him, a demand that Shaw turned down. After that, Gill and Thakur started arguing and misbehaving with the cricketer, the official said.

Gill was arrested last week along with her friend Shobhit Thakur and some others in connection with an attack on the Indian cricketer following an argument over clicking selfies at a suburban hotel and was released on bail by a magistrate court on Monday.

The incident took place last Wednesday outside a luxury hotel at Santacruz in Mumbai following an argument with the social media influencer and her male friend after the cricketer refused to click selfies with her.

Gill, along with her friend Thakur and six others, was booked under Indian Penal Code sections 143 (unlawful assembly), 148 (rioting), 387 (putting a person in fear of death or of grievous hurt in order to commit extortion) and 506 (criminal intimidation).
