Renuka Swamy Murder: Will New Criminal Laws Be Applicable To Darshan, Pavithra Gowda's Case?
The three new criminal laws - Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) - come into effect today (July 1). However, a lingering question remains: will these laws apply to the Renuka Swamy murder case involving actors Darshan, Pavithra Gowda, and others?

Well, the laws are coming to effect from today. However, cases filed earlier will continue under the old laws until their conclusion. However, the new laws will have implication on this case.
The Impact of the new laws
Dr B R Ravikanthe Gowda, Inspector General of Police (Central Range), said that the investigating officers have to deal with both the old and new laws. "The police have to deal with both laws in terms of collection of evidence and criminal procedure, since old law will still be applicable for cases registered on or before June 30," the daily quoted him as saying.
"Cases on and after July 1 will be dealt with as per the provisions of the new criminal laws. The challenge for the police is to keep in mind both procedures as we proceed with investigation."
With the new laws, interpretations will vary among magistrates. Investigators will need time to grasp the legal requirements.
Skipping essential procedures mandated by the new laws during investigations is a significant challenge. This could create loopholes for defense lawyers, weakening the case. However, these are initial interpretations, and further exploration will provide clarity, a cop told the daily.
Renuka Swamy was kidnapped from his native place, Chitradurga, by Darshan's aides for allegedly sending obscene messages to the actor's friend, Pavithra Gowda. He was brutally assaulted in a shed in Kamakshi Palya, leading to his death. His body was then dumped near a drainage in Sumanahalli.
Efficient work by the investigating officers resulted in the rapid arrest of 17 people, including Darshan. Currently, they are in judicial custody.
The New Law
According to the new laws, judgments in criminal cases must be delivered within 45 days of trial completion, and charges must be framed within 60 days of the first hearing.
These laws introduce a modern justice system with provisions such as Zero FIR, online registration of police complaints, electronic summonses via SMS, and mandatory videography of crime scenes for serious crimes.
The new laws aim to address current social realities and modern crimes, providing a mechanism to deal with them effectively while upholding the ideals enshrined in the Constitution, according to official sources.
