Nepal Vice President accuses Supreme Court of acting beyond jurisdiction

Kathmandu, Aug 25 (ANI): Nepal Vice President Paramananda Jha has said that the Supreme Court (SC) acted out of jurisdiction while issuing the order that said his berth will be automatically inactivated if he failed to retake the oath in Nepali language within seven days.

According to Kantipur, the Vice President-who has been dragged into controversies after taking the oath of office and secrecy in Hindi language last year by overlooking the constitutional provisions-claimed that the apex court has tried to create unnecessary controversies by acting beyond its jurisdiction.

Jha referred to the Interim Constitution and argued that according to the Article 36(I) 2 the post of the vice president becomes vacant only if he or she dies, tenders resignation or is impeached.hus, the Supreme Court order is beyond its jurisdiction and unsatisfactory, he said.

The apex court in its final verdict on Sunday said that failure of Vice President Jha to retake oath in Nepali within the given timeframe would mean his legal ouster from the post.

The full bench of the court has also asked the government to make preparations for retaking of the oath of the vice president.

The president, government and the parties in the coalition have earlier urged Jha to retake oath in Nepali. However, Jha has been adamant on not retaking the oath, stating that he would rather resign from the post.

Meanwhile, CPN (Maoist) central secretary Chandra Prakash Gajurel has said there is no alternative for the Vice-President except to obey the Supreme Court ruling.

Speaking at a press meet, Gajurel said the Supreme Court took decision taking the base of interim Constitution, so, it is not necessary to make any opinions on the issue. However, the court decision has raised the debate on language. (ANI)
