HC seeks replies on appointment of state election commissioner

Patna, Oct 01 (UNI) Patna High Court today directed the state government, state election commission to file their replies within 30 days on the alleged violation of Bihar Panchayati Raj Act 2006 during appointment of the state election commission.

Justice R S Lodha and Justice K K Mandal passed the order while hearing a petition filed by a society challenging the appointment of state election commissioner J K Dutta in violation of the relevent sections of Bihar Panchayati Raj Act 2006.

The petitioner pointed out that under the provison of Bihar Panchayati Raj Act, the state election commissioner was to be appointed by the Governor but Mr Dutta was appointed by the Chief Minister.

According to the notification issued for appointment of Mr Dutta as state election commissioner, it was mentioned that he had been appointed by the Governor, the petitioner submitted and added that the details sought under the Right to Information(RTI) Act indicated that he had been appointed by the Chief Minister.
