HC restrains ADJ from hearing Rai murder case

Allahabad, Sep 22 (UNI) The Allahabad High Court today restrained the Ghazipur Fast track Court Additional District Judge Shaileshwar Nath Singh from hearing any application relating to Bharatiya Janata Party MLA Krishnanand Rai murder case.

The Court, however, declared that ADJ can only pass the order of remand of the accused in the case.

ADJ Shaileshwar Nath Singh who was present in the court on the court's direction has been directed to file his reply in this case.

The court has exempted his personal presence in the court. The court has directed both accused Ramu Mallaha and Rakesh Pandey to be personally present in the court on the next date on October 17.

Justice Vinod Prasad has summoned the ADJ on the ground that he has granted bail to two accused of the Rai murder case namely Ramu Mallah and Rakesh Pandey in spite of the fact that the Supreme Court has directed him to consider the bail application of Afzal Ansari, Samajwadi Party MP only, who is also involved in Rai murder case.

The allegation of the CBI was that the ADJ had granted bail to other two accused in violation of the Supreme Court order.

It may be recalled that BJP MLA Krishnanand Rai was murdered on November 29, 2006 along with seven other people near his native village Goundour district Ghazipur.

An FIR was lodged at police station Bhanvarkol by his brother Ram Narain Rai. The CBI is investigating this case on the direction of Allahabad High Court.
