Cong, Govt yet to formulate on creamy layer
New Delhi, Oct 23: The Congress today clarified that neither the party nor the UPA Government had so far formulated its stand on the Supreme Court verdict restricting the creamy layer from getting the benefit of the reservation to SCs and STs.
In any case, the stand of the Congress and the Government on the issue would not be different from each other, Congress Spokesman Abhishek Singhvi said replying to a question at a press briefing here.
He said the apex court verdict on the creamy layer had to be studied and analysed before formulating a stand.
Mr Singhvi said there could be debate on whether there should be reservation for the creamy layer in the OBCs, but it was for the first time that the concept of creamy layer had been applied to the SCs and STs in the jurisprudence. However, it was a decision of the Constitution Bench of the Supreme Court which was binding, he added.
It was debatable when the Constitution makers did not include creamy layer in the reservation for SCs and STs, how could it be included now, Mr Singhvi said.
