No stay for RS by-election on June 15: SC

New Delhi, June 5: The Supreme Court today dismissed a petition seeking stay on the byelection to the Rajya Sabha seat from Uttar Pradesh which fell vacant after disqualification of Samajwadi Party member Jaya Bachchan.

Ms Bachchan was disqualified under article 102 of the constitution for holding an office-of-profit.

A vacation bench comprising Justices Arijit Pasayat and C K Thakker declined to entertain a petition filed by Madan Mohan Shukla whose nomination papers were rejected by the returning officer.

Eleven leaders including senior BJP members Murli Manohar Joshi, Arun Shourie, BSP supremo Mayawati and Ms Bachchan were elected unopposed to the Upper House.

The petitioner had sought stay for the byelection on the ground that if the poll slated for June 15 was not stayed, his election petition pending in the Allahabad High Court challenging rejection of his nomination papers shall become infructuous.

The Supreme Court directed Mr Shukla to go back to the High Court and press his application which is already pending there.

He sought permission to withdraw the petition filed in the apex court. The court granted him permission and the case was dismissed as withdrawn.

The Supreme Court had already dismissed the petition filed by Ms Bachchan challenging her disqualification for holding the post of chairperson of UP film development corporation having a cabinet rank during her tenure as member of the Rajya Sabha.
