SC hearing on exclusion of creamy layer among OBCs in TN in July

New Delhi, May 7 (UNI) The Supreme Court has declined to hear a PIL before summer vacations seeking directions to the state of Tamil Nadu to identify the creamy layer among the other Backward Classes (OBCs) to exclude them from the category so that they do not take benefit of the reservation policy.

A bench comprising Mrs Justice Ruma Pal and Mr Justice A K Mathur yesterday refused to list the matter for early hearing in view of the assembly elections in Tamil Nadu.

The petitioner NGO VOICE (Consumer Care Council) has pleaded for directions to the state in terms of the apex court judgement in the Mandal Commission case delivered on November 16, 1992, directing the government to exclude the creamy layer belonging to OBC category while extending benefits of resevation to the classes entitled for reservation in admissions and employment in educational institutions and in state government services.

The Supreme Court on Friday directed that the petition would be heard after summer vacations in the month of July.

The petition also seeks interim order seeking to restrain the state government from extending the benefit of reservation policy in admission to educational institutions and employment in state government jobs to OBCs without excluding creamy layer segment from the category.

There is 68 per cent reservation in Tamil Nadu for SC/ST and OBCs.
