US Ends Automatic Renewals for Employment Authorization Documents, Impacting Indian Migrant Workers

In a significant policy change, the United States has ended automatic renewals for Employment Authorization Documents (EADs). Starting from October 30, 2025, immigrants renewing their EADs will not receive automatic extensions. The end of automatic extensions poses a risk to their employment stability. Many Indian professionals work in sectors like technology, healthcare, and education.

The Department of Homeland Security (DHS) states that this change aims to enhance national security and prevent fraud. The Trump administration believes that more frequent vetting will help identify individuals with potentially harmful intentions. USCIS Director Joseph Edlow remarked, "Working in the United States is a privilege, not a right," describing the move as a "commonsense" measure.

Who Will Be Affected?

Tens of thousands of foreign workers, especially those on H-1B and dependent visas who rely on EADs for legal employment, will be affected. Existing EADs extended before October 30 will remain valid until their approved period ends. This change follows another controversial move: a $100,000 fee hike for new H-1B petitions, raising concerns across industries dependent on skilled foreign talent.

Guidance for Workers

USCIS advises immigrants to file renewal applications up to 180 days before their EAD expires to avoid employment gaps. This proactive approach is crucial to maintaining continuous employment without disruptions. Workers should be aware of their EAD expiration dates and plan accordingly to ensure timely renewals.

Exceptions to the Rule

There are limited exceptions to this new policy. Extensions mandated by law and renewals under Temporary Protected Status (TPS) announced via Federal Register notices are exempt from this change. These exceptions provide some relief for specific groups of immigrants who meet the criteria outlined in these legal provisions.
