Forced sex in marriage not rape, says court

New Delhi, May 12: A court has recently acquitted a man accused of raping his wife saying that forced sex with a woman does not mean rape if the latter is married to the accused.

Additional sessions judge Virender Bhat said the sexual intercourse between a man and a woman doesn't come within the ambit of rape, even if the same was against the will of the victim. Bhat said this while acquitting Vikash, a man who was accused of raping his wife.

Vikash counter alleged that his wife framed him due to property reasons

Vikash was charged with sedating the woman and taking her to the marriage registrar's office in Ghaziabad where he got the marriage certificates signed by her. Later, Vikash allegedly raped her and abandoned her. The woman then filed a complaint against Vikash in October last year.

On May 7, the court's verdict came.

The accused man said his marriage was solemnised in February 2011 at the woman's house. He said he decided to get their marriage registered upon insistence of his wife and counter alleged that his wife framed him after he failed to get ownership of his sister's house.
