US Appeals Court Declares Ban on Gun Sales to Young Adults Under 21 Unconstitutional

A US appeals court has ruled against a federal law that mandates individuals must be 21 to purchase handguns, citing a violation of the Second Amendment. This decision by the 5th US Circuit Court of Appeals in New Orleans reflects significant changes in gun laws following a pivotal Supreme Court ruling in 2022 that broadened gun rights.

Court Rules Against Gun Sales Ban for Young Adults

The court determined that individuals aged 18 to 20 should not be barred from buying firearms. "Ultimately, the text of the Second Amendment includes eighteen-to-twenty-year-old individuals among the people whose right to keep and bear arms is protected," stated the court's ruling. The case will now return to a lower court judge for further proceedings.

Impact on Federal Gun Laws

Previously, the appeals court had supported age restrictions. However, after the Supreme Court's decision requiring firearm laws to align with historical traditions, judges in states like Minnesota, Virginia, and Texas have invalidated similar regulations. The Biden administration opposed these rulings, while it remains unclear how the Trump administration might respond.

The Supreme Court chose to maintain a federal gun law last year, overturning a different 5th Circuit decision and upholding legislation aimed at safeguarding domestic violence victims. This indicates ongoing debates about balancing gun rights with public safety concerns.

Reactions from Advocacy Groups

Several groups challenged the handgun purchase age restriction, including the Firearms Policy Coalition, the Second Amendment Foundation, and the Louisiana Shooting Association. Alan Gottlieb, founder of the Second Amendment Foundation, remarked, "If we can trust young adults to defend our country, we can certainly trust them to own any and all legal firearms."

Federal law stipulates that one must be 21 to buy a handgun from a licensed dealer and 18 for long guns. However, unlicensed sellers can sell handguns to those 18 or older without restrictions on long guns. Everytown for Gun Safety provided this information based on their research.
