Trump Requests Supreme Court Intervention to Delay Sentencing in New York Hush Money Case
Donald Trump, the President-elect, has approached the Supreme Court to halt the sentencing scheduled for Friday in his hush money case in New York. His legal team sought intervention from the highest court after New York courts denied delaying the sentencing by Judge Juan M. Merchan. Trump was convicted last May on 34 felony counts related to falsifying business records but denies any wrongdoing.

Trump's lawyers argue that the sentencing should be postponed to avoid significant harm to the presidency and federal government operations. They claim that a felony conviction would have severe repercussions, even though Judge Merchan has indicated he will not impose jail time, fines, or probation. The legal team is pushing for an immediate stay of the sentencing.

The emergency motion was filed by John Sauer, Trump's choice for solicitor general, and Todd Blanche, who is set to become a top official at the Justice Department. They argue that Trump's conviction should be overturned based on a Supreme Court ruling granting presidents broad immunity from prosecution for actions taken while in office. This ruling, they say, supports their case against the New York conviction.
The filing asserts that the New York trial court lacks authority to sentence Trump or conduct further criminal proceedings until his appeal concerning presidential immunity is resolved. This includes potential review by the Supreme Court if necessary. Trump's team also plans to seek an emergency stay from New York's highest court, although no filing had been made by Wednesday noon.
Prosecutors' Response and Case Background
Prosecutors are expected to respond by Thursday morning. The Manhattan district attorney's office has stated it will address the matter in court documents. The emergency motion was submitted to Justice Sonia Sotomayor, who handles appeals from New York.
The convictions stem from allegations that Trump attempted to conceal a $130,000 payment to adult film actress Stormy Daniels before the 2016 election. Daniels claims she had a sexual encounter with Trump in 2006, which he denies. Trump's lawyers argue that some evidence used against him should have been protected by presidential immunity.

Trump's legal team contends that testimony from White House aides and social media posts made during his presidency should be shielded by immunity.
