Survivor of Deadly Canada-US Border Crossing Set to Testify in Human Smuggling Trial

An Indian migrant who survived a perilous journey across the Canada-U.S. border in harsh winter conditions is set to testify in a federal trial. The trial involves two men accused of participating in a human smuggling operation that resulted in the deaths of a family of four. Prosecutors claim Harshkumar Ramanlal Patel, 29, and Steve Shand, 50, prioritised profit over human life during their smuggling attempts.

Migrant Survivor to Testify in Smuggling Case

Prosecutors allege that Patel managed part of the smuggling operation and enlisted Shand as a driver. Both men face charges related to human smuggling but have pleaded not guilty. The tragic incident occurred on January 19, 2022, when Jagdish Patel, his wife Vaishaliben, and their children Vihangi and Dharmik succumbed to freezing temperatures while attempting to cross into Minnesota.

Extreme Weather Conditions

The family from Gujarat state was among 11 migrants Shand awaited in his truck as temperatures plummeted to minus 36 degrees Fahrenheit (minus 38 degrees Celsius). Yash Patel, one of the survivors who reached Shand's location, is expected to testify. He was apprehended alongside Shand after being stopped by a border patrol officer.

Prosecutors presented witnesses who described the harsh conditions faced by the Patel family. Daryl Ritchison, a climatologist, noted that frostbite could occur within ten minutes due to the severe cold that morning. Troy Larson, a mechanic, recounted assisting with a van stuck in a ditch that matched Shand's description.

Legal Proceedings and Defence Arguments

Inside the van allegedly driven by Shand, Larson observed a person wrapped in a blanket and a child. Shortly after, border patrol agents stopped the van and arrested Shand. Prosecutor Ryan Lipes stated that despite knowing the extreme weather conditions, Patel and Shand proceeded with their plan to smuggle migrants on foot.

Lipes emphasised that this case revolves around the defendants prioritising profit over lives. He told jurors about the financial gains from smuggling migrants from India into the U.S. Attorney Thomas Leinenweber argued that Harshkumar Patel should not have been charged, stating no evidence linked him directly to any conspiracy.

Defence Strategies

Shand's attorney, Lisa Lopez, urged jurors to distinguish between the defendants. She claimed Shand was an unwitting participant used by Patel and not guilty of conspiracy under the law. Lopez argued that both Shand and the migrants were deceived by Patel's network.

Leinenweber countered that Shand's defence unfairly prejudiced his client. A jury comprising eight men and six women was selected for the trial. Prosecutors intend to present photos of Jagdish Patel and his family's frozen bodies as evidence despite objections from defence attorneys concerned about potential jury bias.

Smuggling Network Details

Federal prosecutors assert that Harshkumar Patel and Shand were part of an international smuggling network targeting clients in India. This network facilitated Canadian student visas and transportation before illegally moving them into the U.S., primarily through Washington state or Minnesota.

Court documents reveal that Patel recruited Shand at a casino near their Florida homes and paid him approximately $25,000 for five trips. Over five weeks, they communicated frequently about the severe cold while smuggling groups across remote border areas.

Border Arrests and Immigration Statistics

The U.S. Border Patrol reported over 14,000 Indian arrests along the Canadian border for the year ending September 30. By 2022, Pew Research Center estimated more than 725,000 Indians were living illegally in the U.S., ranking behind Mexicans and El Salvadorans.

Documents indicate Harshkumar Patel was in the U.S. illegally after multiple visa refusals. During one December night in 2021, Shand messaged Patel about waiting for migrants in freezing conditions: "They going to be alive when they get here?" he allegedly wrote.

In January's final trip, Shand reportedly messaged Patel: "Make sure everyone is dressed for the blizzard conditions, please." These communications highlight their awareness of the dangers involved yet proceeding with their plans regardless.
